Last updated 8/25/2026Carius Terms of Service
Effective Date: August 25, 2026
Last Updated: August 25, 2026
These Terms of Service (“Terms”) govern your access to and use of Carius, including the Carius mobile application, websites, software, services, workout programs, exercise recommendations, training plans, content, and related features (collectively, the “Service”).
By accessing, downloading, registering for, purchasing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be legally capable of entering into a binding agreement to use the Service.
If you are under the age of majority where you live, you may use the Service only with the consent and supervision of a parent or legal guardian.
By using Carius, you represent that you meet these requirements.
2. What Carius Does
Carius is a fitness and exercise planning application designed to help users organize, track, and progress their physical training.
The Service may generate or recommend, among other things:
* exercises;
* workouts;
* repetitions and sets;
* resistance or weight;
* training intensity;
* rest periods;
* exercise substitutions;
* workout splits;
* progression or regression strategies;
* warm-up routines;
* training frequency;
* fitness goals;
* performance targets; and
* other fitness-related information.
Recommendations may be generated algorithmically based on information supplied by you and your previous activity within the Service.
Carius is a fitness software product. It is not a healthcare provider, medical device, medical service, physical therapist, physician, personal trainer, emergency service, or substitute for professional medical care.
3. NOT MEDICAL ADVICE
CARIUS DOES NOT PROVIDE MEDICAL ADVICE.
All workouts, exercises, recommendations, calculations, alerts, explanations, demonstrations, goals, training programs, and other information provided through Carius are supplied solely for general informational, educational, fitness, and recreational purposes.
Nothing provided through the Service constitutes or should be interpreted as:
* medical advice;
* diagnosis;
* treatment;
* physical therapy;
* rehabilitation;
* injury assessment;
* nutritional or dietary medical advice;
* psychological or psychiatric advice;
* a medical prescription;
* clearance to participate in physical activity; or
* a substitute for advice from a physician or other qualified healthcare professional.
Carius does not know your complete medical history and cannot independently determine whether any particular exercise, load, movement, training program, or level of exertion is safe or appropriate for you.
You should consult a physician or other qualified healthcare professional before beginning or materially changing an exercise program, particularly if you have an injury, illness, medical condition, history of cardiovascular problems, physical limitation, are pregnant, take medications that may affect exercise tolerance, or otherwise have reason to believe strenuous physical activity may present a risk to you.
Never disregard professional medical advice because of information provided by Carius.
4. Assumption of Risk
Physical exercise inherently involves risk.
These risks may exist even when exercises are performed correctly and may include, without limitation:
* muscle strains;
* sprains;
* joint injuries;
* fractures;
* falls;
* equipment-related injuries;
* overtraining;
* exhaustion;
* dehydration;
* loss of consciousness;
* cardiovascular events;
* aggravation of existing injuries or medical conditions;
* permanent disability;
* serious bodily injury; and
* death.
BY USING CARIUS, YOU KNOWINGLY AND VOLUNTARILY ASSUME THE RISKS ASSOCIATED WITH EXERCISE AND PHYSICAL ACTIVITY, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
You remain responsible for deciding whether you are physically capable of performing any activity recommended through the Service.
The fact that Carius recommends an exercise, resistance level, repetition target, workout, progression, or other activity does notmean that the activity is safe or appropriate for you.
5. You Are Responsible for Your Training Decisions
Carius provides recommendations. You make the final decision about what you actually do.
You agree to exercise reasonable judgment when using the Service.
You should not attempt a weight, repetition target, exercise, progression, or activity that you reasonably believe exceeds your abilities or can no longer be performed safely.
You are responsible for:
* selecting appropriate equipment;
* inspecting equipment before use;
* using proper exercise technique;
* maintaining a safe exercise environment;
* following equipment manufacturer instructions;
* using safety equipment where appropriate;
* obtaining a qualified spotter when appropriate;
* stopping an exercise when continued performance may be unsafe; and
* seeking qualified professional assistance when necessary.
A recommendation displayed by Carius is never an instruction to continue exercising when you believe doing so would be unsafe.
6. Stop Exercising When Necessary
You should immediately stop exercising if you experience symptoms including severe or unusual pain, chest pain, faintness, severe dizziness, unusual shortness of breath, confusion, loss of coordination, or other symptoms that may indicate a medical problem.
Seek appropriate medical attention when warranted.
Carius is not an emergency service and cannot detect or respond to medical emergencies.
If you believe you are experiencing a medical emergency, contact the appropriate emergency services in your location.
7. Algorithmic Recommendations and Errors
Carius may use software algorithms and user-provided information to generate training recommendations.
Although we work to make these recommendations useful and reasonable, Carius does not guarantee that any recommendation will be accurate, optimal, achievable, appropriate, or safe for a particular user.
Software can make mistakes.
Recommendations may be affected by:
* incorrect user input;
* incomplete information;
* inaccurate performance data;
* incorrect assumptions;
* software defects;
* calculation errors;
* equipment differences;
* changes in a user's physical condition;
* fatigue;
* individual biomechanics; or
* circumstances the Service cannot observe.
For example, a recommended training weight may occasionally be too heavy, too light, or otherwise inappropriate.
YOU AGREE THAT YOU WILL NOT RELY ON CARIUS AS THE SOLE BASIS FOR DETERMINING WHETHER AN EXERCISE OR LEVEL OF PHYSICAL EXERTION IS SAFE FOR YOU.
8. User-Provided Information
Certain features depend on information you provide, such as your training history, experience level, equipment, exercise performance, goals, preferences, and previous workouts.
You are responsible for providing reasonably accurate information.
Carius is not responsible for recommendations affected by inaccurate, incomplete, outdated, or misleading information supplied by a user.
9. Exercise Demonstrations
Carius may display images, animations, GIFs, videos, written instructions, or other materials illustrating exercises.
These materials are intended as general demonstrations only.
They do not guarantee correct form and are not a substitute for individualized instruction from a qualified trainer, physical therapist, coach, or healthcare professional.
Individual anatomy, mobility, injury history, equipment, and other factors may require modifications that cannot be represented by a general exercise demonstration.
10. No Guaranteed Results
Carius does not guarantee any particular fitness, strength, aesthetic, health, weight, athletic, or performance outcome.
Results vary substantially between individuals.
Training recommendations and performance projections are estimates and should not be interpreted as guarantees that you will achieve a particular result.
11. Accounts and Account Security
You may be required to create an account to use some features of the Service.
You are responsible for maintaining the confidentiality and security of your account credentials and for activity occurring through your account.
You agree to provide accurate account information and promptly notify us if you believe your account has been compromised.
12. Acceptable Use
You may use Carius only for lawful purposes.
You may not:
* attempt to gain unauthorized access to the Service;
* interfere with the operation or security of the Service;
* introduce malicious software;
* scrape or systematically extract Service content except as permitted by law;
* reverse engineer the Service except where applicable law expressly permits it;
* impersonate another person;
* use the Service to violate another person's rights;
* resell or commercially exploit the Service without authorization; or
* use Carius in a manner that violates applicable law.
13. Intellectual Property
Carius and its associated software, designs, interfaces, branding, graphics, databases, algorithms, exercise libraries, documentation, and other original content are owned by or licensed to the operator of Carius and are protected by applicable intellectual property laws.
Subject to these Terms, you receive a limited, personal, non-exclusive, non-transferable, revocable license to use Carius for its intended purposes.
These Terms do not transfer ownership of Carius or its intellectual property to you.
14. User Data and Privacy
Our collection and use of personal information are governed by the Carius Privacy Policy.
By using the Service, you acknowledge that information will be collected and processed as described in that policy.
15. Paid Subscriptions
Carius may offer paid subscriptions, including the Spartan Tier, or other premium services.
The price, billing frequency, included features, and applicable trial or promotional terms will be disclosed before purchase.
Unless otherwise stated at purchase, subscriptions automatically renew until canceled.
You may cancel a subscription through the platform or method through which you purchased it. Cancellation prevents future renewal but generally does not retroactively refund amounts already paid except where required by law or expressly stated otherwise.
Purchases made through Apple's App Store or another third-party platform may also be subject to that platform's billing, cancellation, and refund policies.
Prices and features may change. Where required, we will provide appropriate notice before changes take effect.
16. Third-Party Services
Carius may interact with third-party services, platforms, devices, analytics providers, payment processors, application stores, or other technologies.
We do not control third-party services and are not responsible for their availability, accuracy, security, practices, or performance.
Your use of third-party services may be governed by separate terms and privacy policies.
17. Service Availability
We may modify, update, suspend, discontinue, or change any part of Carius from time to time.
We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free.
We may also modify exercises, algorithms, recommendations, progression rules, features, subscription offerings, and other aspects of the Service as the product evolves.
18. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARIUS AND THE SERVICE ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, SAFETY, RELIABILITY, AND AVAILABILITY.
WE DO NOT WARRANT THAT:
* THE SERVICE WILL BE ERROR-FREE;
* RECOMMENDATIONS WILL BE CORRECT;
* RECOMMENDED EXERCISES WILL BE SAFE FOR YOU;
* RECOMMENDED LOADS OR REPETITIONS WILL BE ACHIEVABLE;
* THE SERVICE WILL IDENTIFY OR PREVENT INJURY;
* EXERCISE DEMONSTRATIONS WILL BE APPROPRIATE FOR YOUR INDIVIDUAL CIRCUMSTANCES; OR
* USE OF CARIUS WILL PRODUCE ANY PARTICULAR RESULT.
Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.
19. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CARIUS AND ITS OWNERS, OPERATORS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE.
This includes, to the maximum extent permitted by law, damages arising from:
* exercise-related injuries;
* incorrect exercise recommendations;
* incorrect weight or repetition recommendations;
* falls or equipment accidents;
* overexertion;
* failure to use a spotter;
* reliance on exercise demonstrations;
* inaccurate user information;
* interruption of the Service;
* loss of data;
* lost profits; or
* inability to use the Service.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU ACKNOWLEDGE THAT YOU PARTICIPATE IN EXERCISE ACTIVITIES AT YOUR OWN RISK AND THAT CARIUS IS NOT RESPONSIBLE FOR INJURY, ILLNESS, DISABILITY, DEATH, OR OTHER ADVERSE OUTCOMES RESULTING FROM YOUR DECISION TO PERFORM AN EXERCISE OR WORKOUT.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
20. Maximum Aggregate Liability
To the maximum extent permitted by applicable law, the total aggregate liability of Carius and its owners, operators, affiliates, officers, directors, employees, contractors, and agents for claims arising from or related to the Service will not exceed the greater of:
1. the amount you paid to Carius during the twelve months immediately preceding the event giving rise to the claim; or
2. US $100.
This limitation applies regardless of the legal theory asserted, except where applicable law prohibits such limitation.
21. Indemnification
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Carius and its owners, operators, affiliates, officers, directors, employees, contractors, and agents from claims, damages, liabilities, costs, and expenses arising from:
* your unlawful or improper use of the Service;
* your violation of these Terms;
* your violation of another person's rights; or
* information or content you submit through the Service.
This provision does not require you to indemnify a party for conduct for which indemnification cannot legally be required.
22. Termination
You may stop using Carius at any time.
We may suspend or terminate access to the Service if you materially violate these Terms, misuse the Service, threaten its security or operation, or where suspension or termination is reasonably necessary for legal or operational reasons.
Provisions that by their nature should survive termination—including intellectual property provisions, disclaimers, limitations of liability, dispute provisions, and indemnification obligations—will survive termination.
23. Governing Law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles, except to the extent applicable federal law or mandatory law in your jurisdiction provides otherwise.
24. Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Except for disputes that qualify for small claims court or claims seeking appropriate injunctive relief concerning intellectual property or unauthorized access to the Service, disputes arising from or relating to these Terms or Carius will, to the extent legally enforceable, be resolved through binding individual arbitration rather than a lawsuit in court.
Before initiating arbitration, the party bringing the dispute must provide the other party with written notice describing the dispute and requested resolution and allow at least 30 days for the parties to attempt to resolve the matter informally.
Arbitration will be conducted on an individual basis in accordance with applicable arbitration rules and law.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND CARIUS WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, REPRESENTATIVE ACTION, OR OTHER COLLECTIVE PROCEEDING.
If applicable law prevents enforcement of a particular portion of this section, that portion will be severed or limited to the minimum extent necessary while the remainder remains effective.
25. Changes to These Terms
We may update these Terms from time to time.
When we make material changes, we will update the “Last Updated” date and provide additional notice when required by applicable law.
Continued use of Carius after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.
If you do not agree to updated Terms, you should discontinue use of the Service.
26. Severability
If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent legally permissible or severed where necessary.
The remaining provisions will remain in effect.
27. No Waiver
Failure to enforce any provision of these Terms does not waive our right to enforce that provision later.
28. Entire Agreement
These Terms, together with the Carius Privacy Policy and any additional terms presented for specific features or purchases, constitute the agreement between you and the operator of Carius concerning the Service.
